PROPHETELE Marketing Ltd - COLLECT, PROCESS, STORE and TRANSFER your Personal Data for the following reasons: 

Due to the nature of our business, we collect various types of personal data about you that is personally identifiable (Data from which you can be identified.) We also collect valuable information about you to operate or improve our business or services as well as relevant information we need to know whether that be about yourself personally or the services you provide, including your right to work in the UK. 

TYPES OF PERSONAL DATA AND INFORMATION WE COLLECT ABOUT YOU - Identity Data - (Personally identifiable data, data from which you can be identified, including your right to work in the UK) Contact Data - Financial Data - Transaction and History Data - Marketing and Communications Data - Usage Data - Profile Data - Technical Data - Registration and Contract Data - Qualifications/Education/Experience Data - Accreditations/Certifications/Awards Data - Post Nominal Data - Status and Position Data, i.e. Employment and Company Status (Media Data including demo/audio reels, images you may provide or we may collect from your website or other sources in order to effectively promote your services.) Special Category Data (We may need to know or we may be made aware of any Union Membership particularly where our entertainment industry and voice-over professionals are concerned, e.g. SAG-AFTRA) Criminal Conviction Data (It may be a requirement of our client or our legal obligation to ensure the entertainment artist or otherwise has an Enhanced DBS Check and any unspent criminal convictions are declared (Rules and regulations around safeguarding) This will apply in most cases to entertainment artists or otherwise that are to work with either children or vulnerable adults including those that receive either personal or health care, working with them particularly on a regular basis, e.g. entertainment/services carried out in a nursery school, schools, colleges etc as well as in many cases a child barred list check will be essential.) Some but not all of these data types will be 'Optional' e.g. to provide us with your date of birth in certain circumstances or to disclose any criminal convictions if you do not fit the criteria of needing to disclose them or required to do so by law, however we need to collect particular personal data to enable us in some cases to promote your services or to match the right individual or services with the clients requirements or to offer any employment working for ourselves or third parties whether that be on a Self Employed or Employee basis. Any optional data will be made clear upon the collection of it. Please Note! If you fail or refuse to provide essential information required by law or a condition of our contract, our terms, and conditions, we may not be able to enter into that contract with you or put a contract in place with the third party involved, we may also not be able to provide our services to you. 

Our 'LAWFUL BASES' for processing your personal data will fall under the following categories:

CONSENT - LEGITIMATE INTERESTS - CONTRACT - LEGAL OBLIGATION - (You will always have the right to object to the processing of direct marketing.) The majority of our processing of your personal data will fall under LEGITIMATE INTERESTS and CONTRACT even prior to a contract been put in place between yourself and a third party, in cases where our intention and yours is to enter into a contract subject to your completion of our registration form and acceptance of our draft contract (Terms and Conditions) prior to for example any booking of your act/services from a third party or the supply of services to you from a third party. (Due to 1 of our roles within the services we provide, been acting as an 'Agent' you need to accept our commission % and the content within the terms and conditions we create between yourself and the third party as well as us, in most cases relating to our entertainment industry/voice-over professionals and the third party looking to book their services, however this could also apply to any third party service provider we deal with.) The sending to you our registration form and draft contract is for the purpose of your acceptance and entering into that agreement, therefore our lawful basis of both LEGITIMATE INTERESTS and CONTRACT. (It is worth mentioning to aid understanding that none of our entertainment/voice-over providers or other service providers are exclusive to us in any way or obligated to undertake any work we may offer them however where services are provided, the conditions within this privacy policy will apply.) In cases of 'Exclusive' providers our terms and conditions will be made clear. It is also our LEGAL OBLIGATION to notify you of these terms and conditions including our commission prior to our putting in place any contract between yourself and the third party or notify you of any changes to them, hence our processing of your personal data will also fall under our lawful basis of LEGAL OBLIGATION. Our LEGITIMATE INTERESTS will remain as a lawful basis in most of our processing of your personal data even when or after a contract has been put in place as well as before, we will therefore have more than 1 lawful basis in most cases for processing your personal data. E.g.. to provide you with our ongoing services, to request your ongoing services, to continue promoting your services or to simply maintain our relationship with you and keep you updated. Our LEGITIMATE INTERESTS could also include to manage any debts due to us from you or to suggest services that may be of interest to you. This will apply to both artist/service provider and the booker/client. Our purpose of processing your personal data in most cases is to develop/continue an ongoing relationship with you, maintain contact with you, put a contract in place and notify you of any terms and conditions or changes which we are legally obligated to do, hence our lawful bases of LEGITIMATE INTERESTS, CONTRACT and LEGAL OBLIGATION. (Please refer to further information below relating to our lawful bases and the processing of your personal data as well as the collection, storage and sharing of it.) No matter what personal data we process, in most cases our LEGITIMATE INTERESTS will apply particularly in cases where our processing of your personal data is not required by law, we are processing your personal data in a way you would expect us to use your data or to avoid constantly bothering you to do what you would expect us to do with your personal data or in some cases demo/audio reels. All processing of personal data will be processed under a particular circumstance and our relationship with you will vary from person to person, business to business and based upon that circumstance/relationship/reason for processing your personal data will we record the lawful basis of which we rely on. 

All processing of your personal data will be recorded internally including the lawful basis of which we rely on for the processing of it.

HOW WE COLLECT PERSONAL DATA ABOUT YOU - Information you provide when you register with us or ask about our services - Information you provide when you contact us - Information you provide when you complete our survey - Information provided to us by our preferred partners, other companies or third parties that have your permission to share your information with us, in some cases need to share your information with us, (E.g. we may be supplying to you joint services with our preferred partner, or even taking over the enquiry entirely.) HOW WE USE THE PERSONAL DATA WE HOLD ABOUT YOU - We use the personal data we hold about you to verify your identity - To register you as a new customer, preferred partner or supplier - To process and deliver any services you may have requested from us including to promote your own services, this may include the sharing of your audio/demo reels to our social media sites or via other methods of marketing. Due to the nature of our business it is necessary for us to use your personal data to enable us to promote your services particularly where our entertainment artists and voice-over actors/artists are concerned as well as our service providers - We need your personal data to enable us to put 'Booking Forms' and 'Contracts' in place with third parties to supply your services, again particularly where our entertainment artists, voice-actors/artists are concerned. Your personal data will be used for the purpose it was collected however there may be reasons to process your personal data for another reason that we feel is compatible with the original purpose, this could be without your knowledge or consent however permitted by law.

SELLING OF YOUR PERSONAL DATA - We do not and will not sell your personal data.

DISCLOSURE AND SHARING OF YOUR PERSONAL DATA WITH THIRD-PARTIES - Your personal data will be shared with third-parties as follows: (Business - Preferred Partners/Suppliers/Service Providers/Our Clients connected with our contract with you, e.g. - Our entertainment industry artists/acts and the venue they are to perform or our third-party sleeper coach provider that will be transporting members of your act for the purpose of any contract we may enter with yourself or them or in some cases prospective clients or any third-party interested in your services.) E.g. a hotel considering to book your act or wanting a demo/audio reel of your services or a Client/Prospective Client considering booking 'Voice' or the service you offer for their project (The third-party personal data equally may be shared with you) As 1 of our roles within the services we provide is 'Agent' a vital part of that role is sharing information whether that be demo/audio reels or personal data. We may outsource some of our work to a third-party or ask a third-party to act on our behalf, this could be a preferred partner or otherwise, in this case they will be provided with your personal data that is relevant to carrying out what we have asked them to do. The third-party may assist with our administrative duties, assist with providing your requested services or even assist in promoting your own. It may be necessary for us to share your email address, personal data or your communication to us with a third-party and they may respond on our behalf, particularly where complex technical issues are involved and the third-party will provide that service on our behalf. (Due to the nature of our business services it is necessary for many reasons to share your personal data with our business partners/third-party service providers to both assist ourselves and provide in most cases our joint services to you. It will also be necessary in most cases for the third-party to collect, process and store your personal data and depending on circumstance, possibly also transfer.) Your personal data will in most cases where our closely connected 'Preferred Partners' are concerned be stored and processed in the same way as we will store and process your personal data ourselves. INTERNATIONAL TRANSFER OF YOUR PERSONAL DATA - To enable us to provide our services, dealing with particularly entertainment industry and voice-over industry artists in various countries in our role as 'Agent' or otherwise, it may be necessary for us to transfer your personal data and/or demo/audio reels/images to another country. (We both receive and will send demo/audio reels/personal data from/to another country and a lot of our contacts/artists are outside of the UK however within the EEA) In some cases the personal data of the entertainment/voice-over artist/supplier or otherwise will also be transferred. By dealing with PROPHETELE Marketing Ltd or providing your personal data to us, you agree to the transfer, storage, and processing of your personal data outside of your country of residence. Within our registration form when you register with us you will be given an option whether to agree or disagree with your personal data/demo/audio reels or images transferred/processed or stored in a country OUTSIDE OF THE EEA however by dealing with PROPHETELE Marketing Ltd or providing your personal data/demo/audio reels/images to us you are agreeing to the transfer, storage and processing of it WITHIN THE EEA. This obviously applies to entertainment, voice-over artists/service providers/individuals that are happy to travel Internationally or provide global services as well as possibly in some cases receive them. PROPHETELE Marketing Ltd will make every effort to ensure your personal data is treated securely and in accordance with our own privacy policy and a strict confidentiality agreement put in place however you must understand that some of these countries outside of the EEA do not follow GDPR rules or may not have appropriate safeguards in place to protect your personal data. 

PERSONAL DATA - INFORMATION OF CHILDREN (MINORS) PROPHETELE Marketing Ltd do not knowingly obtain or gather personal data from children, nor do we send personal information requests. We have no control over the age or the visitors of our website. Visitors of all ages visit our website and we do not intentionally collect personal data from those under the age of 18. If by any means, we are informed that a minor/young person under the age of 18 has improperly registered to any of our services by providing false information we will cancel any registration and delete all information provided to us. In exceptional circumstances particularly relating to the entertainment industry it is not uncommon to come across teen stars or those under the age of 18 and in this circumstance the matter will be taken up with the parent or guardian.  

SECURITY OF YOUR PERSONAL DATA - We want to offer you peace of mind that we are aware of our responsibility to keep your data safe and secure, this includes in the office environment, whilst travelling, as well as online. We make every effort to ensure your personal data is safe and secure and not shared with third-parties. (Please also refer to the platform providers security policies) In cases where we provide you with or ask you for a password or pin, please ensure you keep this safe and do not share it with anyone, it is your own responsibility to ensure it is not shared with third-parties. In cases where more than 1 person needs to contact us on your behalf, a separate password/pin will need to be provided by us or to us. (Without the password or pin we may refuse to speak with you or access your personal data.) Note! Transmission online is not entirely safe or secure and we have no control over the transmission of your personal data to our website or services. If our site contains links to other sites or third-party platforms, please ensure your read their own privacy and cookie policies, we do not accept any responsibility/liability for their privacy policies. In the case of any personal data breach both you and the I.C.O will be informed where the law requires us to do so. Should you need to send us demo/audio reels/media please ensure that you use secure file transfer to do so. Any processing of payments to us will be made wherever possible via a secure platform offering advanced data encryption such as PayPal Business to ensure your payments are safe and secure. STORAGE OF YOUR PERSONAL DATA - Your personal data will be stored safely and securely and will not be retained for longer than necessary for us to achieve the purpose for which we obtained or collected it, this includes any legal/regulatory obligations we may have. We will then delete or anonymise the personal data we hold so that it cannot be linked back to you.

OUR RESPONSE TIME TO YOUR GDPR REQUEST - PROPHETELE Marketing Ltd will have 30 days, to respond to your data protection request from receiving it. If we receive your request on the 6th of the Month we will have until the 6th of the following month to comply. If we receive your request on the 31st and the following month does not have 31 days we will have until the 30th of the following month to comply. If the 30th falls on a weekend or public holiday, we will have until the end of the next working day to comply. 

PROPHETELE Marketing Ltd reserve the right to REFUSE REQUESTS if they are repeated or unfounded whether or not the requests are vexatious. (Any identical or similar repeated requests to a point of been excessive or clearly unreasonable will be refused.) We also reserve our right to charge a fee in such cases.
